The situation in Syria has raised the cockles of America’s political punditry. Or something like that. Even amateur pundits* are getting in on the action, casting barbs about how they “found Iraq’s WMD’s”, blah blah blah. (*Amateur political pundits = my co-workers. I use “pundit” with a tablespoon of salt here.)

For those of you who have been living under a rock for the past week or so, Syria allegedly used chemical weapons on its own citizens on Aug 21st.

As the Obama administration considers how to respond to the use of chemical weapons in Syria, Vice President Joe Biden said Tuesday that there is “no doubt” that Syrian President Bashar al Assad was responsible for the Aug. 21 chemical weapons attack near Damascus

Hey, Joe Biden said so, it must be true…

So, now we are at a crossroads as far as what to do.

Strictly speaking from a Constitutional standpoint (not that that matters), the President cannot simply declare war on Syria; only Congress can declare war against another nation.

[Congress shall have Power...] To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

(From the Constitution of the United States of America, Article 1, Section 8)

In other words, “The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.”
